Bodó City Council informs the Supreme Federal Court of the total suspension of LotSeridó in the municipality.
The Bodó City Council informed the Supreme Federal Court of full compliance with the preliminary injunction that ordered the suspension of LotSeridó's activities in the municipality. The statement was sent on Monday (January 19th) to Minister Nunes Marques, rapporteur of the Argument of Non-Compliance with Fundamental Precept No. 1212, presented by the Solidarity Party.
The document, signed by lawyer Iara Maia da Costa, legal representative of the municipal legislature, details that the suspension of LotSeridó's operations occurred on October 24, 2025, even before the Supreme Court's preliminary injunction. The suspension included all accreditations, contracts, and bidding processes linked to Municipal Complementary Law No. 01/2024.
The precautionary decision issued by Minister Nunes Marques in ADPF 1212 ordered the immediate suspension of all municipal lotteries operating in Brazil, affecting dozens of municipalities that had created their own betting systems, including fixed-odds modalities such as sports betting and online games.
Complete repeal of municipal legislation
The Bodó Legislative Assembly also announced the enactment of Municipal Complementary Law No. 05/2025, of December 8, 2025, which fully revoked Complementary Law No. 01/2024 and all administrative acts derived from it, with immediate effect.
"There is currently no regulatory or administrative act authorizing the operation of a municipal lottery service in the city," states the text sent to the Supreme Court.
The Supreme Court's ruling suspended the effectiveness of all municipal regulations that created lotteries and authorized the operation of these services, ordering the immediate cessation of ongoing operations and prohibiting municipalities from enacting new regulations related to these activities.
Commitment to oversight
The City Council has pledged to inform the Supreme Federal Court (STF) if it identifies any action by the municipal Executive branch that may contradict judicial rulings. This stance reflects the oversight function that falls to the municipal Legislative branch.
The case in question discusses the constitutionality of municipalities operating lottery services. ADPF 1212, under the rapporteurship of Minister Nunes Marques, questions the municipal authority's competence to legislate on games and lotteries, a matter traditionally attributed to the Federal Government.
In the decision affecting Bodó and other municipalities, Nunes Marques highlighted that lottery services have a strictly national character in legislative terms, and a national and regional character in administrative terms. According to him, the matter demands a high degree of care from the public authorities in standardization and a centralized regulatory structure.
Law 14.790, of December 2023, amended Law 13.756/2018 and centralized in the Ministry of Finance the responsibilities for regulating and accrediting companies authorized to operate betting, giving normative treatment to the operation of lotteries by the States and the Federal District, without including the municipalities.
Failure to comply with the decision will result in a daily fine of R$ 500 for municipalities and companies that continue to provide lottery services, and R$ 50 for mayors and presidents of companies that continue to operate lottery activities.
