The Official Gazette of the Union this Friday (10) did not include the ordinances with the new rules for advertising online sports betting announced the day before by the Minister of Finance, Dario Durigan. The publication was expected in the regular edition, but the normative texts were left out.
According to BNLData's investigation, the regulations are still expected to be published this Friday (10) in an extra edition of the Official Gazette.
Minister Durigan had announced on Thursday (9) the changes planned for the betting sector. The ordinances bring the new guidelines for advertising online betting platforms, but the details of the announced measures were not available for integration into this report from the source material consulted.
Rules for all vehicles
In an interview, Minister Durigan stated that “all media outlets, all TV channels, radio stations, internet platforms, are subject to these rules. Any and all commentators who comment on betting are prohibited from inducing people to gamble, for example, by giving a personal opinion. 'Oh, this team is very good, so you can certainly bet and you will win a prize.' That is not allowed,” he explained.
He argued that the level of authority induces people to gamble more and become indebted. "Therefore, it is not the role of the commentator, from the government's point of view, to encourage gambling," he continued.
Durigan stated that 56 betting websites, apps, and platforms have already been taken down in the country so far. In addition, nearly a thousand influencer profiles have been removed from social media. In the case of self-exclusion, where individuals request to be removed from the system, almost one million people have already been excluded.
"This information that betting companies have been providing to the Ministry of Finance is being shared, always with due process, with other authorities and has allowed us to launch operations in the country to hold accountable those who violate our rules," he stated.
He also stressed that a ruling by the Supreme Federal Court (STF) is being enforced, prohibiting beneficiaries of social programs, such as Bolsa Família and BPC, from accessing these betting platforms. According to Durigan, tens of millions of people are prohibited from accessing these platforms due to this decision.
The minister also highlighted the recent announcement of the ban on predictive market platforms, which are prohibited from operating in the country, and stressed that within the Desenrola program, both the Desenrola Inadimplente and the Desenrola Adimplente programs, debtors who use the program to renegotiate their debts also automatically exclude themselves from the possibility of playing the game.
The National Consumer Secretary of the Ministry of Justice, Ricardo Morishita, spoke about the role of the National Consumer Protection System. “We will work together so that this fight can be carried out throughout the country, leveraging the reach of the National Consumer Protection System – state and municipal Procons, Public Defenders' Offices, Public Prosecutor's Office – to ensure compliance with existing regulations,” he told Estadão.
"Bets is a dangerous service, it also falls under the Consumer Protection Code, and warnings and mechanisms to prohibit and prevent deception, but above all, abuses, are necessary," added the representative from the Ministry of Justice.
