Minister of Agriculture signs instruction. regulations that allow international simulcasting
The edition of this Monday (31) of the Official Gazette of the Union publishes the normative instruction signed by the Minister of Agriculture, Roberto Rodrigues, which authorizes Brazilian Jockey Clubs to collect bets and races held in other countries. In fact, the instruction publishes the General Betting Plan which now provides for this possibility of simulcasting with other countries and gave a period of 60 days for interested clubs to adapt to the new text.
The Brazilian, Paraná, and Rio Grande do Sul Jockey Clubs were already anticipating the new legislation, and the first "racebook" agency to receive this type of bet should be installed in Porto Alegre in December.

Normative Instruction No. 21, of October 27, 2005

The Minister of State for Agriculture, Livestock and Supply, in the exercise of the powers conferred upon him by Article 87, sole paragraph, item II, of the Constitution, and in view of the provisions of Law 7.291 of December 19, 1984, and considering the primary objective of creating a national horse breed and the need to include the betting system called "Simulcasting" in the General Betting Plans of the Jockey Clubs, resolves:

Article 1. To approve the Regulations of the General Betting Plan, as set forth in Annex I to this Normative Instruction.

Article 2. Establish a period of 60 (sixty) days for all Turf Entities holding a Patent Letter to submit their General Betting Plans in accordance with the rules established in the Regulation.

Art. 3 This Normative Instruction comes into force on the date of its publication.

ANNEX: GENERAL BETTING PLAN REGULATIONS1 – Definitions
Article 1. General Betting Plan – This is the instrument that establishes the various types of bets, regulating them separately and conveniently so that the bettor is fully aware of the entity's procedure regarding the calculation, distribution of winnings, percentage of withdrawals, and the particularities that govern the system adopted by it.
§ 1 This instrument may constitute a type of betting related to the exhibition of horse races, without image generation and transmission, with image generation and transmission to the venues where the bets are placed, and also with the exhibition of horse races, through images generated at other racetracks, located in Brazil or abroad, transmitted live to the venues where the bets are placed, in this case, called "Simulcasting".
§ 2 The transmission of the image generated and received in the premises authorized to place bets must include, at a minimum, the following data that enable betting on the races:
– Name and number of the horse
Jockey
– Jockey's weight
– Distance of the race
– Track type (sand or grass)
– Track condition
Article 2. Bets – are all forms of gambling for money carried out on horse races, sponsored by legally authorized entities, including contests, lottery games, auctions or betting auctions.
Sole paragraph. Bets will be placed in accordance with the modalities foreseen in the General Betting Plan, duly approved by the competent body of MAPA, and may only be placed on the premises of the racetrack, at the social headquarters and sub-headquarters of the jockey clubs, in authorized agencies and through accredited agents.
Article 3. Hippodrome – The venue for horse racing competitions, with betting operations, in accordance with the General Betting Plan, the National Racing Code, and the rules established in its own regulations.
Article 4. General Betting Movement – This is the total value of bets, announced for each race, for the purpose of calculating the prize distribution.
General Betting Plan Article 5 The General Betting Plan must include:
I – the types of bets separately:
II – the unit price of each ticket:
III – the percentage to be deducted by the turf entity from the total amount wagered, in each type of bet;
IV – the calculation for the distribution of payouts to bettors in each of the betting modalities;
V – the minimum and maximum bonus limits for bets;
VI – In case of annulment, refunds and ticket replacements due to errors in issuance, non-completion of one or more races, withdrawal of animals, or any other unforeseen circumstances;
VII – the locations and times for receiving each type of bet;
VIII – the method of advertising bets;
IX – the statute of limitations for betting slips;
X – the destination of any amounts not received due to the expiration of the ticket price;
Article 6. Bets will only be accepted in legally permitted locations designated for this purpose.
§ 1 It is considered the bettor's obligation to check their bet (meeting, race, value and indications) immediately after it is placed, and no subsequent complaints will be accepted.

§ 2. Anyone who purchases betting slips will be subject to the provisions of this plan and the relevant legislation.

2 – Types of Bets
2.1 – Pulês
Article 7. The type of bet called WINNER refers to the animal that is considered the winner of the race.
Article 8. The type of bet called PLACE refers to the animals that are considered to be in first or second place in the race.
Article 9. The betting modality called SHOW refers to the animals that finish in the top three positions.
Article 10. The type of bet called DOUBLE refers to the animals that obtain first and second place in the race, regardless of the order of arrival.
Sole paragraph. In the event of a tie for first and/or second place, the net prize will be divided into as many parts as there are winning combinations, observing the following criteria:
a) In the event of a tie between two animals for first place, the entry corresponding to the tied horses will be considered the winner;
b) In the event of a tie between three or more animals for first place, all entries corresponding to the tied animals will be considered winners;
c) In the event of a tie for second place, the entries for first place will be considered winners along with the animals in second place; and
d) In any case of a tie, if there are no bets on any of the winning combinations, the net proceeds from this portion will be distributed among the other combinations considered to be winners.
Article 11. The type of bet called EXATA refers to the animals that obtain first and second place in the race, in that order.
Sole paragraph. In the event of a tie for first and/or second place, the net prize will be subdivided separately for each exact winning combination, observing the following criteria:
a) In the event of a tie between two animals for first place, the entries corresponding to the tied horses will be considered the winners;
b) in the event of a tie of 3 (three) or more animals in first place, all entries corresponding to the tied animals will be considered winners;
c) In the event of a tie for second place, the entries for first place will be considered winners along with the animals in second place; and
d) In any case of a tie, if there are no bets on any of the winning combinations, the net proceeds from this portion will be distributed among the other combinations considered to be winners.
Article 12. The type of bet called TRIFETA refers to the animals that obtain first, second, and third place in a given race.
§ 1 In races where forfeits or withdrawals, for any reason, reduce the number of animals under different numbers to less than 4 (four), the bets will be cancelled and the amounts wagered will be returned to the holders of the respective tickets.
§ 2 In cases where a tie occurs, the following criterion will be observed:
a) In the event of a tie between two animals for 1st place, the winning entries will be those corresponding to the tied animals plus the animal that comes in 3rd place;
b) In the event of a tie between three or more animals for 1st place, all entries corresponding to the tied animals will be considered winners;
c) In the event of a tie between two animals for 1st place and also for 3rd place, all entries corresponding to the animals tied for 1st place and those tied for 3rd place will be considered winners;
d) In the event of a tie for 2nd place, the entries for 1st place will be considered winners along with the animals tied for 2nd place;
(e) In the event of a tie for 3rd place, the winning entries will be those corresponding to 1st place plus 2nd place plus the animals tied for 3rd place;
f) In any case of a tie, if there are no bets on any of the winning combinations, the net proceeds from this portion will be distributed among the other combinations considered to be winners.
Article 13. The type of bet called QUADRIFETA refers to the animals that obtain first, second, third, and fourth place in a given race.
§ 1 In races where forfeits or withdrawals, for any reason, reduce the number of animals under different numbers to less than 5 (five), the bets will be cancelled and the amounts wagered will be returned to the holders of the respective tickets.
§ 2 In the event of a tie between two or more competitors, the value of winning bets to be distributed will be divided among the sum of the combinations.
2.2 – Of the Accumulated
Article 14. Accumulator bets will be of the Simple and Combined types and may adopt the following denominations:
Double Accumulator, Triple Accumulator, Quadruple Accumulator, Sextuple Accumulator and Super Trifecta, as described in the following articles.
Article 15. SIMPLE ACCUMULATORS are bets on a winning animal in two, three, four, or six different races. COMBINED ACCUMULATORS may indicate one or more winning animals per race, and if the first
If the prediction is successful, the initial bet multiplied by the payout of the race will be applied to the prediction(s) of the following race, and so on.
§ 1 The calculation of the final distribution will correspond to the distributions multiplied successively and cumulatively, using only the first decimal place of each multiplication, adding the regulatory bonuses to the resulting product and multiplying the amount found by the value of the initial bet placed.
§ 2 The tickets for simple/combined accumulators will contain the initial amount wagered and the numbers of the animals indicated as the winner, with the valid numbers being those listed in the official program.
Article 16. Simple/combined accumulators will only be accepted in races where three or more animals appear under different numbers.
Art. 17. Winning Simple/Combined Accumulators will have the bonuses guaranteed by the turf entities supplying the races in which the bets are collected.
Article 18. In the event of a forfeit or withdrawal of any animal bet on for any type of Simple Accumulator, the respective accumulator will be equated to that of one less race, with the right, in the case of being a winner, to the bonus corresponding to the resulting accumulator, except in the case where there is (another animal(s) under the same number), in which case the accumulator will not undergo any alteration, with the bettor competing with the remaining animal(s).
§ 1. If any of the animals that are part of a Supertri is declared a forfeit or withdrawn for any reason, the bonus percentage for all combinations containing this animal will only be calculated on the races in which there is a correct prediction. That is, if the bettor correctly predicts only two races and the animal is withdrawn from the third, they will be entitled to the bonus for those two races and not the special Supertri bonus. In the case of correctly predicting only one race, with the other two non-participating predictions, the bettor will not be entitled to any bonus.
§ 2 In cases where a race is reduced to fewer than three animals, bets placed on that race will be void, and all bets placed on it will be considered a forfeit or withdrawal, applying the provisions described in caput of this article.
§ 3 In the event of the cancellation of a race, the accumulated prize money will be equivalent to that of one less race, as provided for in caput of this article.
§ 4 In the event that, if any of the circumstances provided for in this Article or in its paragraphs 1, 2 and 3 occur, the accumulated prize is reduced to a single winning entry, the prize money for this entry will be paid out as if it were a single entry, without entitlement to any bonus.
§ 5 In the event that an animal or race not listed in the program is indicated in the accumulated results, and in the event of any doubt or error in the indications of a race, the provisions of this Article shall apply.
Art. 19. The SUPERTRIFETA event consists of correctly predicting the competitors who finish in first, second, and third place, in that exact order, in two races to be designated.
3 – About the Awards
Article 20. The official result of a race will only be announced after it has been confirmed.
§ 1 The subsequent alteration of the result of a race may not, under any circumstances, be invoked for the acceptance of betting slips, which will always be governed by the results confirmed immediately after the race.
§ 2. The apportionments will always be announced based on R$ 1,0 (one real) and in values that represent only the first decimal place, disregarding the others. Under no circumstances will the final apportionment be announced with a value lower than R$ 1,0 (one real).
Article 21. Animals listed in the program under the same order number (double) will be included on the same ticket in the betting modalities, with the bettor competing with all animals running under the same number. Therefore, it will not be necessary to indicate repeated numbers in the Double, Exacta, Trifecta, and Quadrifecta modalities, as for the purpose of determining the results of these modalities, only the animal that obtains the best placement will count, disregarding the others with the same number, and considering the animal(s) from the following classification(s).
Single paragraph. Exceptions will be made in the Place and Show categories. In the case of Place, if the first two placed animals are included in the program under the same order number (double), the prize money will be calculated for a single animal. In the case of Show, if the first three animals are part of a double, the prize money will be calculated considering only one animal.
Article 22. From the total amounts of bets placed, taxes due by law and the percentages established for withdrawal by the promoting entities will be deducted, and the distribution of prizes to the winning tickets will be calculated as follows:
I – WINNER – The percentage established for the withdrawal of the promoting entities and the taxes due by law are subtracted from the total bets; then the balance is divided by the total amount bet on the winning animal, and the result will be the winner's share. In case of a tie between two or more animals, the percentage of the society, the taxes due by law, and the sum of the amounts bet on the tied animals are subtracted from the total bets, and the balance is divided into as many equal parts as there are animals, and then each of these parts is divided by the number of betting units advertised on each animal, and the result of these divisions plus R$ 1,0 (one real) will be the share for each winning animal.
II – DOUBLE and EXACT – the procedure is identical to that for the Winner.
III – PLACE – the procedure is the same as for a tie in the winner category. If a tie is observed between two or more animals in first place, these will be considered the winning place winners, and if the tie is for 2nd place, half of the prize money will be awarded to the 1st place animal and half to the animals tied for second.
IV – SHOW – the procedure is the same as for a tie in the winner category. If a tie is observed between three or more animals in first place; one animal in first place and two or more tied for second; two animals tied for first place and one or more animals tied for second, these will be considered the winning shows. In the event of a tie for third place, one third of the prize money will be awarded to the first-place winner, another third to the second-place winner, and half to the animals tied for third.
V – TRIFETA – The percentage established for withdrawal by the Turf Entity and the taxes due by law are subtracted from the total bets; then the balance is divided by the total amount wagered on the winning combination(s) and the result will be the Trifeta payout. In case of a tie between two or more animals, in any position of the trifeta, the payout will be obtained by dividing the net balance by the winning combination(s) so that winning formulas may have different payouts, inversely proportional to the amount wagered.
VI – QUADRIFETIME – The percentage established for withdrawal by the Turf Entity and the taxes due by law are subtracted from the total bets; then the balance is divided by the total amount wagered on the winning combination(s) and the result will be the Quadrifective payout. In case of a tie between two or more animals, in any position of the quadrifective, the payout will be obtained by dividing the net balance by the winning combination(s) so that winning formulas may have different payouts, inversely proportional to the amount wagered.
Article 23. When, for any reason, an animal is declared a forfeit or withdrawn from a race before the start, bets on the Winner, Place, Show, Double, Exacta, Trifecta and Quadrifecta categories (in proportion to the number of non-competing combinations) that have been placed on it will be refunded, if the animal does not appear under the same order number as any other competitor, in which case the bet will not be altered.
§ 1 The bets in the double, exacta, trifecta and quadrifecta modalities that contain an animal withdrawn will be returned to the bettors (in proportion to combinations not competing due to the withdrawal).
§ 2. Bets placed on animals that are disqualified, remain stationary during the race, or suffer any accident after the race that prevents them from finishing the course, or not, will not be refunded.
Article 24. The betting limits, the value of combinations, and the locations and times for receiving bets will be established by the Racing Commission and communicated to the betting public through an official means of dissemination, including the possibility of advance bets.
§ 1. Different values may be established for combinations of the same type of bet, even in the same meeting, in order to provide greater incentive for the modality on a given day or race.
§ 2. If the provisions of § 1 of this article are adopted, bets in this modality will not undergo any alteration regarding the rules of their plan.
Article 25. Winning tickets will only be paid to their holders, and no claim of loss, theft, misplacement, or any other complaint will be considered. Tickets that are torn or defaced, or whose authenticity cannot be proven, will not be paid.
Art. 26. Winning tickets will be valid for 08 (eight) consecutive days, starting from the day of the program itself, and their value will revert to the Promoting Entity after this period has elapsed.
Art. 27. The percentages for gross withdrawal from the Winner, Place, Show, Double, Exacta, Trifecta, and Quadrifecta categories will be the same as those practiced by the racetracks supplying the races; respecting the withdrawal limit established by Article 23, § 2 of Decree No. 96.993/88, which amended Law No. 7.291/84.
Single paragraph. Accumulator bets will pay bonuses to winning tickets according to the percentages and conditions stipulated in this Plan.
Article 28. In the event of the cancellation of a race, bets will be maintained and will remain valid until the race is held.
Single paragraph. If a race is cancelled, bets on the Winner, Place, Show, Double, Exacta, Trifecta and Quadrifecta categories will be cancelled and the amounts wagered will be returned to the holders of the respective tickets. The other categories will follow the provisions of this plan.
Art. 29. In the modalities in which it is permitted to place bets with the indication of several combinations on the same ticket, it will be possible for more than one winning combination to occur, especially in cases of a tie or if more than one winning place or show is indicated.
Article 30. The turf entity may choose not to adopt any of the betting modalities provided for in these Regulations in its betting system.
4 – Operation
Article 31. The race promoter that conducts betting through simulcasting, whether National or International, must submit, along with its General Betting Plan, a Contract with the entity generating the images, for approval.
Article 32. The opening of Agencies and Accredited Agents in other States or Municipalities must be preceded by the following measures:
a) Agreement between the promoting entity and similar entities;
b) Approval by the Ministry of Agriculture, Livestock and Supply of the agreement referred to in the preceding paragraph;
c) Presentation of the contract between the Agency or Accredited Agent and the promoting entity, for approval purposes.
Article 33. The entity promoting the races must provide a program containing all the information necessary to guide the bettor.
Art. 34. With the program in hand, the bettor may, at their option, go to the betting window, choose the types of bets, the amount to bet, and receive proof of the bet placed.
Art. 35. Once the race has taken place and its result confirmed, the prize distribution for each type of bet will be announced, and the discounts determined by law will be observed.
5 – Regarding the collection of funds and their allocation
Article 36. The collection and allocation of resources must comply with the provisions of articles 50 et seq. of Decree 96.993, of October 17, 1988, and related laws, with the promoting entity being obliged to collect 1,5% of the Total Betting Volume and pay it to the Ministry of Agriculture, Livestock and Supply.
Article 37. The funds allocated to the Ministry of Agriculture, Livestock and Supply will be collected monthly, through the issuance of a Federal Collection Form – GLU, into a specific account provided by the Ministry of Agriculture, Livestock and Supply, by the 10th day of the following month.
Article 38. Changes to the General Betting Plan will only be permitted if the Turf Entity has fully paid the amounts due to the Ministry of Agriculture, Livestock and Supply.
6 – Oversight of Tourism Entities
Article 39. Turf entities are obligated to provide the officials responsible for inspection with all the necessary clarifications, as well as to show them, when requested for examination or expert analysis, the documents, books, receipts, balance sheets, and any other elements deemed necessary for the exercise of the inspection activity.
Article 40. Turf organizations are required to submit a monthly report to the competent body of the Ministry of Agriculture, Livestock and Supply containing the following information:
I – number of races completed;
II – total bets and contests for each meeting;
III – the total amount of prizes paid out at each meeting;
IV – the percentage of the Total Betting Volume that is distributed as prizes;
V – the percentage of withdrawals made, in each type of bet, by the company promoting the race;
VI – the total contribution to be collected by the Ministry of Agriculture, Livestock and Supply;
VII – Additional clarifications when requested.
Article 41. The promoting entities are obliged to make information available to the Ministry of Agriculture, Livestock and Supply. on line of the volume of bets, without prejudice to the obligations of the previous article.
7 – Penalties
Article 42. In the event of a violation of any of the provisions of this Regulation, the provisions of articles 91 to 97 of Decree 96.993, of October 17, 1988, shall apply.
