Normative Instruction SPA/MF No. 11, of November 4, 2024
Regulates the registration of the domain name “bet.br” for use in electronic channels offered by operators of the fixed-odds betting lottery modality.
The Secretary of Prizes and Betting of the Ministry of Finance, in the exercise of the powers conferred upon him by article 55, caput, item I, subparagraph “d”, of Annex I of Decree No. 11.907, of January 30, 2024, and considering the provisions of article 29, § 3, of Law No. 13.756, of December 12, 2018, article 7, § 1, item VII, of Law No. 14.790, of December 29, 2023, and article 5 of SPA/MF Ordinance No. 722, of May 2, 2024, resolves:
Article 1. This Normative Instruction regulates the registration of the domain “bet.br” for use in electronic channels offered by operating agents of the fixed-odds betting lottery modality, as referred to in Article 5 of SPA/MF Ordinance No. 722, of May 2, 2024.
Article 2. Fixed-odds betting operators must submit a domain registration request for “bet.br” on the website https://registro.br/, of the Brazilian Internet Steering Committee (NIC.br), after receiving the notification referred to in Article 16, paragraph 1, of Ordinance SPA/MF No. 827, of May 21, 2024.
Sole paragraph. The requests mentioned in the heading must:
I – comply with the rules established by the Brazilian Internet Steering Committee (NIC.br) for contracting the service; and
II – indicate the corresponding “bet.br” domain registrations, at most, to the total number of trademarks to be exploited, subject to authorization from the Prizes and Betting Secretariat of the Ministry of Finance, in accordance with the provisions of Article 5 and item 4.2 of Annex I of SPA/MF Ordinance No. 827, of May 21, 2024.
Article 3. The Prizes and Betting Secretariat of the Ministry of Finance will examine the requests for registration of “bet.br” domains registered in the Information and Coordination Center of the .BR Domain – NIC.br by fixed-odds betting operators and will verify the following criteria:
I – date of registration of the registration request subsequent to the date of notification of authorization referred to in article 16, caput, of SPA/MF Ordinance No. 827, of May 21, 2024; and
II – indication of “bet.br” domain registrations corresponding to the trademarks to be exploited, subject to authorization from the Prizes and Betting Secretariat of the Ministry of Finance.
Single paragraph. The use of Domain Name System Security Extensions – DNSSEC registration technology is mandatory for registering “bet.br” domains.
Article 4. In the event of a decision by the Secretariat of Prizes and Bets of the Ministry of Finance unfavorable to the request referred to in Article 2, after examination of the criteria in Article 3, the fixed-odds betting operators will be notified by the Information and Coordination Center of the .BR Domain – NIC.br, and may submit an appeal to the email address [email protected] within fifteen days from the date of receipt of the notification.
Article 5. Disputes arising from the registration of "bet.br" domain names between fixed-odds betting operators will be resolved through the Internet Dispute Resolution System for Domain Names under ".br" (SACI-Adm), in accordance with the contract for domain name registration under ".br", available at https://registro.br/dominio/contrato/, and with the Regulations of said System, available at https://registro.br/saci-adm/.
§ 1 In the event of the initiation of the procedure referred to in the heading, the personal data necessary for identification and communication with the domain holder and other information necessary for the instruction of the procedure will be shared with the institution accredited by the Information and Coordination Center of the .BR Domain – NIC.br, responsible for the administration and decision of the procedure, observing the provisions of Law No. 13.709, of August 14, 2018, and with the consent of the holder.
§ 2 In addition to the communication referred to in § 1, the personal data for identifying the domain holder will be included in the decision to conclude the procedure, which may be published on the websites of the Brazilian Internet Steering Committee (NIC.br) and the accredited institution, with the consent of the holder.
§ 3 The Prizes and Betting Secretariat of the Ministry of Finance will be notified by the Information and Coordination Center of the .BR Domain – NIC.br of the cases referred to in the heading via the email address [email protected] , and will respond within fifteen days of receiving the notification.
Article 6. After a favorable decision from the Secretariat of Prizes and Bets of the Ministry of Finance regarding the request mentioned in Article 2, based on the examination of the criteria in Article 3, fixed-odds betting operators must observe the conditions and take the measures indicated by the Information and Coordination Center of the .BR Domain – NIC.br for the registration of the “bet.br” domains.
Article 7. Registered “bet.br” domains must be reported by fixed-odds betting operators in a specific field of the Betting Management System – SIGAP of the Secretariat of Prizes and Bets of the Ministry of Finance within five days of the registration date.
Article 8. Requests for changes to already approved "bet.br" domain registrations will follow the procedures defined by the Information and Coordination Center of the .BR Domain – NIC.br, in accordance with the provisions of this Normative Instruction.
Art. 9 This Normative Instruction comes into force on the date of its publication.
