The Rio de Janeiro City Hall published a decree this Monday (July 13th) prohibiting the display of advertising for betting platforms in public spaces within the municipality. The measure applies to all locations with outdoor advertising, street furniture, and other places whose operation depends on authorization, license, permission, or concession from the municipality.

The decree aims to protect the urban landscape, strengthen city planning, and reduce the population's exposure, especially that of children and adolescents, to advertising for sports betting platforms and online gambling. Enforcement will be carried out by the Licensing and Inspection Coordination (CLF), which will order the immediate removal of illegal advertisements and apply the sanctions stipulated in municipal legislation.

The ban applies to any form of advertising by these companies, including trademarks, logos, company names, apps, websites, promotional campaigns, bonuses, slogans, mascots, and any other elements capable of directly or indirectly identifying the betting platforms.

"The Rio de Janeiro City Hall will not accept the use of outdoor advertising, which is regulated by the municipality and belongs to all Rio residents, whether from public or private property, to promote an activity that has caused indebtedness, compulsion, and destroyed Rio and Brazilian families," stated Mayor Eduardo Cavaliere.

The measure also mandates that municipal government agencies and entities observe the new rule in all contracts, concessions, permits, licenses, and authorizations involving advertising on public property. Furthermore, the prohibition now applies to events sponsored, contracted, or organized by the City Hall.


RIO DECREE No. 58274 OF JULY 10, 2026

It prohibits the display of outdoor advertising and advertising in public spaces for fixed-odds betting platforms, and provides other measures.

 The Mayor of the City of Rio de Janeiro, in the exercise of the powers conferred upon it by current legislation, and

Considering the Municipality's competence to promote proper territorial planning, regulate the use of urban land, protect the urban landscape, and exercise administrative police power over the exploitation of advertising within its territory;

Considering the provisions of articles 30, I and VIII, and 182 of the Constitution of the Republic, which grant the Municipality the power to legislate on matters of local interest and to promote adequate urban planning;

WHEREAS it is the responsibility of the Municipality to regulate the use of municipal public assets and establish criteria for the exploitation of advertising spaces subject to its authorization, always in accordance with the local public interest;

WHEREAS the economic exploitation of advertising structures, street furniture, and other spaces intended for advertising, when dependent on a license, authorization, permit, concession, or other municipal administrative act, constitutes an activity subject to administrative police power and the conditions established by the Public Authority;

WHEREAS articles 83, VIII, and 84, II, of Complementary Law No. 269 of 2023 prohibit the dissemination of advertising that is offensive to morals and good customs or that harms the rights of third parties and individuals;

Considering the severe impacts resulting from overexposure to fixed-odds betting advertising (bets) and electronic gambling have a negative impact on the mental health of the population, especially children and adolescents, and the prohibition of advertising gambling is based on Article 16, III, of Federal Law No. 14.790, of December 29, 2023,

DECREE:

Art. 1º The display of outdoor advertising and advertising in public spaces is prohibited throughout the entire territory of the Municipality of Rio de Janeiro, in accordance with Complementary Law No. 269, of December 12, 2023, when aimed at promoting fixed-odds betting platforms conducted through virtual means (bets) and similar applications for sports or non-sports betting online.

Single paragraph. The seal contained in caput This article is based on the prohibitions established in article 83, VIII, and article 84, II, of Complementary Law No. 269, of December 12, 2023, as it constitutes propaganda offensive to morals, good customs, and the social protection of families.

Art. 2º The prohibition established in this Decree applies, among other things, to the dissemination of:

I – trademarks;

II – Business names;

III – digital platforms;

IV – websites;

V – applications;

VI – commercial promotions;

VII – institutional or promotional campaigns;

VIII – bonuses, prizes or incentives related to betting activity;

IX – logos, symbols, visual elements, mascots, slogans or any other elements intended for the direct or indirect identification of legal entities authorized to operate fixed-odds betting or platforms intended for the operation of this activity.

Art. 3º Failure to comply with the provisions of this Decree will subject offenders, including exhibiting companies and advertisers, to the penalties provided for in Article 124 of Law No. 691, of December 24, 1984, as amended by Complementary Law No. 269, of December 12, 2023, without prejudice to the immediate revocation or annulment of the license.

Art. 4º It is the responsibility of the Licensing and Inspection Coordination Office – CLF to oversee compliance with this Decree, adopt the administrative measures necessary for its execution, and order the immediate removal of advertisements that do not comply with its provisions.

Art. 5º The organs and entities of the Municipal Public Administration must observe the provisions of this Decree in the execution, renewal, extension or revision of contracts, concessions, permits, authorizations, licenses and other instruments involving advertising exploitation in public assets or spaces subject to municipal police power.

Art. 6º The prohibition established in this Decree also applies to advertising campaigns and events contracted, sponsored, or carried out by the direct and indirect Municipal Public Administration.

Art. 7º The provisions of this Decree shall have immediate application, and it is the responsibility of advertisers and advertising or publicity companies to remove active advertisements and adapt authorized devices to the terms of this regulation.

Single paragraph. The application of the fines provided for in article 124 of Law No. 691, of December 24, 1984, as amended by Complementary Law No. 269, of December 12, 2023, is suspended for a maximum and non-extendable period of 10 (ten) days, counted from the date of publication of this Decree.

Art. 8º Article 37-A is added to Rio Decree No. 55.648, of January 13, 2025, with the following wording:

"Article 37-A. The display of outdoor or exterior advertising for fixed-odds betting conducted through virtual means is prohibited at events (bets), including its trademarks, logos, symbols, designations, expressions, slogans, icons, pictograms, images and any graphic elements.”

Art. 9º This Decree shall come into force on the date of its publication.
