Caixa publishes new circular with rules for lottery permits and extends deadlines for document regularization.

CAIXA Econômica Federal published Circular No. 1.084 which establishes new rules for lottery permits in Brazil. The document was published this Tuesday (23) in the Official Gazette of the Union and brings changes to several operational aspects of the sector.
The circular, dated December 22nd, consolidates rules regarding selection, service provision, marketing of lottery products, and operational standards. Among the main changes is the modification of the limit on permits per CPF/CNPJ (Brazilian individual/company tax identification number), as per item 2.3 of the document.
The text includes a provision for the creation of points of sale linked to lottery outlets for the sale of physical tickets for the Exclusive Instant Lottery (Lotex). This measure is included in item 5.1.4 of the regulation.
It is worth highlighting that this new circular represents an evolution in relation to CAIXA Circular No. 1.077, published on December 11, 2024, which had already eliminated the mandatory quota of LOTEX tickets for the lottery network. The previous version (CAIXA Circular 1062/2024) contained this requirement, which led to a complaint from the Brazilian Federation of Lottery Companies (FEBRALOT) to CAIXA, requesting the correction of what they considered an error.
The name “Expresso Parceiros” has been changed to “Conexão Parceiros”, according to item 19.1.4.2. CAIXA also removed the item previously classified as contractual amendment and modification to the Articles of Association, which was in item 20.1.1, subsection IX.
The deadline for regularizing documentation in the event of a partner's death has been extended from 180 to 240 days, as specified in item 20.1.7.1. The circular also changed the deadline for corporate changes, detailed in item 20.1.2.1, subsection II, and eliminated the provision for exceptions to this deadline, previously present in item 20.1.2.2.
The wording regarding the timeframe for acting with a power of attorney has been modified, expanding the exceptions, as stated in item 22.4. In financial terms, the document defines that the movement of funds in the account linked to the accounting account will be exclusively for amounts originating from lottery or combined activities, as per item 24.3.2.
In Annex I, there was a change in the percentages of the contract amendment fee schedule for lottery outlets and USLs. The document also establishes a fixed fee for corporate changes between partners with a degree of kinship and excludes the provision for changing the contract amendment fee.
Annex II reduces the percentage from 15% to 10% when the total points reach or exceed 20 points in the last 12 months. CAIXA also determined the exclusion of additional charges granted by the institution in the calculation of fees (Annex I) and fines (Annex II).
The document defines the accounting account as the recipient of Pix payments related to lottery revenue, acting as a Correspondent, and financial settlements, following rules predefined by CAIXA, as per item 2.3.1.1 of Annex III.
