Bill 2234/22 (PL 442/91) will be considered by the Senate's Constitution, Justice and Citizenship Committee.

In 2018, the Senate's Constitution, Justice and Citizenship Committee (CCJ) approved a separate vote by Senator Randolfe Rodrigues rejecting PLS 186/14, authored by Senator Ciro Nogueira, which would have legalized gambling in Brazil. Because the bill had been approved by the Special Committee on National Development or the Agenda Brasil, the proposal went to the Plenary and remained there for four years until it was shelved at the end of the previous legislature.
Following the Senate President Rodrigo Pacheco's order for Bill 2234/22 (PL 442/91) to be reviewed by the same CCJ (Committee on Constitution, Justice and Citizenship) and the appointment of Senator Irajá to report on the proposal in the Committee, several subscribers consulted BNLData about the chances of the proposal advancing in the committee and going to a vote in the Senate Plenary.
It is worth highlighting that the scenario and composition of the commission were quite different from the current formation. In 2018, evangelical parliamentarians, led by Senator Magno Malta, allied themselves with those from left-wing parties and managed to approve a separate vote against the proposal, precisely from the current leader of the government in Congress.
Currently, the Senate has a faction opposed to the legalization of gambling, composed of 24 senators, which represents 29,6% of the House's parliamentarians. The following senators, in alphabetical order, are officially registered with the 'Parliamentary Front for a Brazil without Gambling': Astronaut Marcos Pontes (PL-SP), Carlos Portinho (PL-RJ), Carlos Viana (PODEMOS-MG), Cleitinho (REPUBLICANOS-MG), Damares Alves (REPUBLICANOS-DF), Eduardo Girão (NOVO-CE), Eliziane Gama (PSD), Flávio Arns (PSB-PR), Hamilton Mourão (REPUBLICANOS-RS), Izalci Lucas (PSDB-DF), Jorge Kajuru (PSB-GO), Jorge Seif (PL-SC), Laércio Oliveira (PP), Luis Carlos Heinze (PP-RS), Magno Malta (PL-ES), Mara Gabrilli (PSD-SP), Paulo Paim (PT-RS), Plínio Valério (PSDB), Rodrigo Cunha (UNIÃO-), Sergio Moro (UNIÃO-PR), Styvenson Valentim (PODEMOS), Vanderlan Cardoso (PSD) and Zequinha Marinho (PL).
The recent approval of Bill 3626/23 in the Economic Affairs Committee proved that not all members of this committee voted against the legalization of online betting.
The 'Opponents' group will hinder the processing and approval of the proposal in the Senate Plenary, but with the current composition of the CCJ (Committee on Constitution, Justice and Citizenship), the strength of those opposed may be limited, unless they manage to find new allies in the committee to keep gambling illegal.
The Senate's Constitution, Justice and Citizenship Committee (CCJ) is composed of 27 full senators and 27 alternate senators, while those opposed total 15 members. Among the full senators, seven are in the lead: Sérgio Moro, Plínio Valério, Eliziane Gama, Flávio Bolsonaro, Carlos Portinho, Magno Malta, and Eduardo Girão. The alternate senators are eight: Carlos Viana, Vanderlan Cardoso, Mara Gabrilli, Paulo Paim, Jorge Kajuru, Zequinha Marinho, Jorge Seif, and Hamilton Mourão.
Senators in the CCJ (Committee on Constitution, Justice and Citizenship) who support the legalization of gambling number 24 in total, with 12 as full members and 12 as alternates. For strategic reasons, we will not mention the names of these parliamentarians. This number could increase if the proposal receives support or exemption from the Presidential Palace.
next stage
With the selection of the rapporteur in the CCJ by Senator Davi Alcolumbre (União-AP), the deadline for submitting amendments is now open.
After the report is presented to the CCJ (Committee on Constitution, Justice and Citizenship) and if approved, the bill will proceed to the Senate Plenary for consideration. If there are modifications to the text approved by the deputies in February 2022, the proposal returns to the Chamber of Deputies for the parliamentarians to accept or reject the changes proposed by the senators, but if the proposal is approved in the Senate without changes, Bill 2234/22 (PL 442/91) goes to the President for sanction.
After the presidential approval of the law that creates the Regulatory Framework for Gambling in Brazil, the issuance of the regulatory decree will be necessary within a period of up to 12 months.
