The rapporteur for Bill 3.626/23 in the Sports Committee (CEsp), Senator Romário (PL-RJ) presented his report on the proposal that regulates sports betting in Brazil this Wednesday morning (18). The senator accepted Amendments number 14-U, 48-U and 61 and rejected the other amendments presented by parliamentarians.

After the debates, which included the participation of Senator Leila and Senators Eduardo Girão, Cleitinho and Carlos Portinho, a collective review was granted for a period of 24 hours and a request was approved for a public hearing in the Senate Sports Committee, which will be held next Monday (23), at 10 am.

"The approval of the bill has great potential to increase tax revenue, organize the fixed-odds betting market, allow for oversight, actions to curb match-fixing, guarantee consumer rights, and regulate advertising and marketing," Senator Romário explained.

Time for fixed grants and two brands

The senator accepted Amendments 14-U from Senator Soraya Thronicke and 48-U from Senator Nelsinho Trad, which address the duration and amount of time for fixed grants, which remain limited to a maximum of R$ 30 million, but allow for the exploitation of up to two commercial brands to be operated by the legal entity on its electronic channels per authorization act and for a period of five years.

“We welcomed Amendment 14-U with the aim of allowing the Ministry of Finance to grant authorization for fixed-odds betting operations for a period of up to five years, instead of just three years,” Romário notes.

Advertising and marketing

Senator Romário also accepted amendment number 61, authored by Senator Jorge Kajuru, which argues that communication, advertising, and marketing actions for fixed-odds betting lotteries will comply with the regulations of the Ministry of Finance, encouraging self-regulation, and that advertising and promotion of betting will be aimed at an adult audience, so as not to target children and adolescents.

Redistribution of sports resources

Another amendment presented by Senator Romário redistributed the allocation of resources from sports betting. The rapporteur increased the amount allocated to sports from 6,63% in the project approved by the Chamber to 6,68%, with the following distribution:

III – 6,68% (six and sixty-eight hundredths percent) for the sports area, through the following breakdown:

.............................................................................................................

    1. j) 0,05% (five hundredths of one percent) for the Brazilian Master Sports Committee.

…………………………………………………….

V – 4,30% (four and thirty hundredths percent) for the tourism sector, through the following breakdown:

    1. a) 0,80% (eighty hundredths of one percent) for the Brazilian Agency for International Tourism Promotion (Embratur); and
    2. b) 3,50% (three and fifty hundredths percent) for the Ministry of Tourism.

VI – 0,5% (zero point five percent) to the Ministry of Health, for measures to prevent, control and mitigate social harm arising from the practice of games in health areas.

VII – 0,15% (fifteen hundredths of one percent) divided among the following civil society entities:

    1. a) 0,05% (five hundredths of one percent) for the National Federation of Associations of Parents and Friends of Exceptional Children (Fenapaes);
    2. b) 0,05% (five hundredths of one percent) for the National Federation of Pestalozzi Associations (Fenapestalozzi);
    3. c) 0,05% (five hundredths of one percent) for the Brazilian Red Cross.

Ban on betting on isolated football events.

The rapporteur also presented an amendment aimed at prevention, and to curb match-fixing in football, an amendment was introduced prohibiting bets on isolated events within football such as corner kicks, throw-ins, red and yellow cards.

"As a way to prevent match-fixing, in football, betting on isolated events that occur during a sporting event is prohibited. In football, isolated events include corner kicks, throw-ins, red cards, and yellow cards," Romário argues.
