The Rio de Janeiro government is asking the minister to reconsider ADPF 492.

The Attorney General of the State of Rio de Janeiro, Leonardo Espíndola, filed this Thursday (9) a request for reconsideration of the decision of Minister Gilmar Mendes, rapporteur of the Argument of Non-Compliance with Fundamental Precept (ADPF) 492 in the Supreme Federal Court (STF), which decided to apply the abbreviated procedure provided for in article 12 of Law 9.868/1999. The abbreviated procedure provides for the judgment of the case directly on its merits, without going through the analysis of the request for preliminary injunction.
The State government is challenging in the Supreme Federal Court (STF) the fact that the Secretariat for Economic Monitoring of the Ministry of Finance – SEAE/MF, considered not only illegal, but a criminal offense, the exercise, by the State of Rio de Janeiro, through LOTERJ, of the activity of raffles and forecasts, and against provisions of Decree-Law 204/1967 that deal with the Union's monopoly to operate lotteries.
Comment
In an interview with CBN Radio, the Secretary for Economic Monitoring of the Ministry of Finance, Mansueto Almeida, reported on changes to the concession model for the Exclusive Instant Lottery, Lotex, and the concession period, which has been extended to 15 years with a minimum initial grant value of over R$ 500 million.
If the Supreme Federal Court (STF) finds that Rio de Janeiro's argument in ADPF 492 is valid, the value of Lotex will be affected by this decision. Furthermore, the concession fee will also be affected if gambling is legalized by the National Congress before the lottery concession auction.
Comment I
The Brazilian Federal Savings Bank (Caixa Econômica Federal) is just waiting for the Lotex operation to be added to the product mix of Caixa Lotteries.
