A mother who entered a lottery shop in São Paulo with her 14-month-old baby without a mask during the Covid-19 pandemic was refused service. The woman was wearing a mask, but her daughter was not, due to her age. Even so, the shop employee allegedly threw her out and treated her rudely, according to the São Paulo State Court of Justice. Now, the establishment will have to compensate her with R$ 10.

In the proceedings, the mother stated that the lottery shop was full of customers at the time and that the employee unnecessarily exposed her to an embarrassing situation. "In short, the plaintiff alleges that the defendant failed to follow a recommendation from ANVISA (Brazilian Health Regulatory Agency) issued two months prior to the incident and essential for the safety of a 14-month-old baby, as the use of a mask could cause suffocation, refusing service in a rude and abusive manner, expelling the appellant from the establishment, and shaming her," says the rapporteur, Judge Ramon Mateo Júnior.

According to Mateo Júnior, there was abuse and the demand was clearly unreasonable. "The dynamics of the event itself, given that there is information indicating the lottery shop was full of customers at the time, inexorably demonstrates that there was humiliation that caused anguish and suffering," he concluded.
