Gambling or Luck?
In recent days, news outlets have been using the expression "gambling," mainly in relation to the slot machine crisis. But the true definition of "gambling" or "game of chance," as Professor Oswald de Souza teaches for BNL, is one in which luck decides the outcome, as happens in Mega-Sena, Quina, Loto, Sena, scratch-off tickets, lottery tickets, bingo, slot machines, and programmed electronic machines (video bingo). To avoid being considered "gambling" or "game of chance," players must have knowledge and skill in the modalities being played, such as blackjack, poker, biriba, pif-paf, tranca, jockey, and sports betting. Therefore, if it is decided that "gambling" is prohibited, CEF (Caixa Econômica Federal) and state lotteries will have to close their doors. What does the Brazilian Penal Code stipulate: Decree-Law No. 6.259, of February 10, 1944, in the chapter on Contraventions, Article 45 states: “To draw lottery tickets without regular authorization from the competent authority or without the ratification contemplated in Article 3. Penalties: from 1 (one) to 4 (four) years of simple imprisonment, fine, in addition to forfeiture to the National Treasury of all extraction equipment, furniture, utensils and assets belonging to the lottery.”
