The proposals for "Health Lottery" and "Tourism Lottery" as numerical prediction lottery modalities received nine amendments in plenary session. Among the proposals are the creation of the "Education Lottery" and the "Emergency Aid Lottery".
The proposal is expected to be reviewed this week by the full Chamber of Deputies.
The amendments demonstrate how parliamentarians and their advisors are unaware of the current legislation regarding lotteries and the concept of this service.
Amendment 1, proposed by Congressman Capitão Wagner (PROS-CE), argues that resources allocated to the National Health Fund (FNS) will be used exclusively for actions to prevent, contain, combat, and mitigate the effects of the pandemic.
Amendment 2, proposed by Representative Haroldo Cathedral (PSD-RR), argues that states and the Federal District can establish their own lotteries upon request to the Ministry of Economy. The resources derived from income tax on lottery prizes would be exclusively allocated to the states and the Federal District, with preferential destinations in the health sector. The executive branches would define the frequency and execution of the contests, the prize amounts, the unit value of bets, the percentages and limits of expenses for operating costs, and the maintenance of the lottery operator. In 2021 and 2022, the resources from the lottery would be allocated to health actions to combat the effects of the Covid-19 pandemic.
Amendment 3, proposed by Representative Aureo Ribeiro (Solidariedade-RJ), argues that prizes not claimed by winning bettors within the statute of limitations will be exclusively allocated to actions for the prevention, containment, combat, and mitigation of the effects of Covid-19, preferably for the purchase of vaccines.
Amendment 4, proposed by Congressman Bosco Costa (PL-SE), argues that for the duration of Covid-19 response measures, 15% of lottery revenue will be allocated to the National Health Fund (FNS) for use in preventing and combating the coronavirus. The Ministry of Economy will regulate how these funds will be transferred to the National Health Fund.
Amendment 5, proposed by Representatives Bohn Gass (PT-RS), Wolney Queiroz (PDT-PE), Jorge Solla (PT-BA), and Danilo Cabral (PSB-PE), argues that the "Tourism Lottery" is temporary in nature, and the prediction contests associated with it may only be held until December 31, 2021. Furthermore, the net income from the "Tourism Lottery" contests, as well as the value of prizes not claimed by bettors within the statute of limitations, will be allocated to the General Tourism Fund – Fungetur, exclusively for granting credit operations to the tourism sector aimed at mitigating the economic impacts caused by the pandemic.
Amendment 6 , also proposed by Representatives Bohn Gass (PT-RS), Wolney Queiroz (PDT-PE), Jorge Solla (PT-BA), and Danilo Cabral (PSB-PE), argues that prediction contests will be run by Caixa Econômica Federal and authorized by the Ministry of Economy, which will determine the form, frequency, and execution of the contests, the setting of prizes, the collection of income tax on prizes, the unit value of bets, percentages, and limits on expenses for the operation and maintenance of the lottery operator.
Amendment 7 by Eduardo Bismarck (PDT/CE) advocates for the creation of the "Emergency Aid Lottery," whose net income, as well as the value of its prizes not claimed by bettors within the statute of limitations, will be allocated to the payment of supplementary emergency aid of R$ 600,00.
Amendment 8, proposed by Representatives Talíria Petrone (PSOL-RJ), Vivi Reis (PSOL-PA), Marcelo Freixo (PSOL/RJ), Fernanda Melchionna (PSOL-RS), Áurea Carolina (PSOL-MG), David Miranda (PSOL-RJ), Glauber Braga (PSOL-RJ), Ivan Valente (PSOL-SP), Luiza Erundina (PSOL-SP), and Sâmia Bomfim (PSOL-SP), argues that the competitive examinations covered by this Law will be conducted by Caixa Econômica Federal.
Amendment 9, proposed by Representatives Eduardo Bismarck (PDT-CE), Wolney Queiroz (PDT-PE), Danilo Cabral (PSB-PE), Bohn Gass (PT-RS), Idilvan Alencar (PDT-CE), Leônidas Cristino (PDT-CE), André Figueiredo (PDT-CE), Subtenente Gonzaga (PDT-MG), Gustavo Fruet (PDT-PR), Silvia Cristina (PDT-RO), Paulo Ramos (PDT-RJ), Fábio Henrique (PDT-SE), Dagoberto Nogueira (PDT-MS), and Flávia Morais (PDT-GO), advocates for the creation of the "Education Lottery," whose net income from prediction contests and the value of prizes not claimed by bettors within the statute of limitations will be mandatorily allocated to investment in connectivity, computerization, and technological equipment to guarantee internet access for educational purposes to students and teachers in public basic education.
Request for joinder
In addition to the amendments, Representative Paulo Bengtson (PTB/PA) submitted a request asking that Bill 4423/2020, authored by him, be attached to Bill 1561/2020, as they deal with related matters. The proposal amends Law No. 13.756, of December 12, 2018, to authorize Caixa Econômica Federal to hold an additional and exclusive lottery contest in 2020.
